Shorewood man faces federal pornography charges
A Shorewood con-man’s elaborate set-up backfires. Now David Foley faces federal charges of producing child pornography and molesting two boys. Ironically, all of this started with an anonymous tip to FOX6 Investigator Bryan Polcyn.
The FOX6 Investigators received a cardboard envelope on August 16, 2010. It contained an anonymous letter and a single, unlabeled compact disc. The person who sent the package claimed to have found the disc while rummaging through a dumpster behind a Whitefish Bay business.
When Polcyn loaded the disc into his computer, he found a folder labeled “Andy Garrison’s private files.” Inside were disturbing images of young boys engaged in sexual acts. The FOX6 Investigators turned everything over to Eric Szatkowski, an agent for the State Department of Justice.
According to the report, “Andy Garrison was the target of the set-up…The connection between the two starts with a building that thousands of people pass every day in Whitefish Bay…Foley was renting office space from Garrison.”
Garrison talked to FOX6 News off camera and said Foley owed him $55,000 in rent. Garrison threatened to have Foley thrown in jail. Investigators now say that’s when Foley decided to retaliate.
Two months after the package was sent to FOX6, records show Foley made additional attempts to smear Garrison’s name. It included planting a laptop computer loaded with the child porn next to Garrison’s car, posting false and defamatory statements on the internet, and claiming Garrison was a child molester.
In April 2011, the case took a disturbing turn. Two underage boys came forward to say David Foley had molested them in Shorewood, Whitefish Bay and at the Mall of America. Investigators say Foley photographed and videotaped the assaults.
On Wednesday, a grand jury indicted Foley on charges of producing and distributing child pornography, and transporting a child across state lines for a sex act. He was simultaneously charged in state court with crimes related to bad checks and those defamatory web postings about Andy Garrison.
Foley is in Fox Lake Correctional Center where he’s been since March on prior, unrelated financial charges.
