Man charged after allegedly breaking into home, looking at porn

FOX POINT -- 50-year-old Otha Smith Jr. of Menomonee Falls has been charged after allegedly breaking into a Fox Point home Saturday, April 14th and looking up pornography on a computer.

Smith was charged in Milwaukee County Circuit Court Monday, April 16th with one count of burglary and one count of possession of burglarious tools.

According to the criminal complaint in the case, just before 3:00 a.m. Saturday, a Fox Point family contacted Fox Point police after they were woken up by someone going through drawers in the downstairs portion of their home.

Police found a patio door ajar, and spotted Smith walking towards a bicycle parked in the driveway of the home. Smith then got on the bike and attempted to flee through some bushes, but was caught and arrested.

Smith was carrying a Leatherman utility knife and two flashlights. The complaint states Smith told police he met a man named "Rog" the night before, and they planned to burglarize a home. Smith said he was supposed to be on the lookout while Rog committed the burglary, but Rog apparently changed his mind.

The day after the burglary, the homeowner discovered an iPad in the home had been opened and someone had gone onto the family computer and had looked up pornographic websites.

Smith is currently being held in Milwaukee County Jail on $5,000 bail. If convicted, he faces up to 16 years in prison and $35,000 in fines.
