Brandy Allen sentenced to five years in prison

MILWAUKEE -- Brandy Allen, the woman accused of killing her daughter while driving drunk on Christmas Day, was sentenced to five years in prison plus six years of extended supervision Friday morning, June 8th. Allen's drivers license will also be suspended for seven years, and she'll have to undergo counseling and parenting classes.

"I am truly sorry," 37-year-old Brandy Allen said before a judge Friday. ""No statement or judgements will make me feel worse than I already do."

Words of regret moments before a judge sentenced Allen.

"You took your kids and you put them at risk, and unfortunately, the most tragic of things happened," Judge Rebecca Dallet said.

Allen was scheduled to be sentenced last month, but that was postponed because her lawyer was sick.

This past April, Allen pleaded guilty to homicide by intoxicated use of a vehicle and injury by intoxicated use of a vehicle. In exchange for those guilty pleas, prosecutors dropped three other charges

Prosecutors say Allen was drunk when she crashed into a parked semi trailer, killing one of her daughters and critically injuring the other.

According to the criminal complaint in this case, Allen was driving her two daughters home around 2:00 a.m. Christmas night, when she took her eyes off the road to address her five-year-old daughter Jahanyuh in the backseat. Then, Allen’s 10-year-old daughter Brianna yelled “mommy” right before their car ran into the parked semi.

After police arrived on the scene, they ran a record check of Allen with the Wisconsin Department of Transportation, and learned Allen’s driver’s license was suspended. Officials also performed a sobriety test on Allen. The complaint says the tests did show evidence that Allen may be impaired. She was transported to the State of Wisconsin Crime Laboratory for a blood draw, which showed her BAC was .107.
