31-year-old man arrested for second OWI, with a child in his car

WAUKESHA -- Wisconsin State Patrol (Waukesha Post) officials arrested 31-year-old Jose Garcia of Milwaukee for operating a motor vehicle under the influence (second offense) with a child in the vehicle.

Garcia was arrested just before 7:00 p.m. Sunday, June 10th on southbound Moorland Road, south of I-94.

A State Trooper observed Garcia not wearing his seatbelt, as well as a small child unrestrained in the back seat of the vehicle.

The Trooper detected the odor of intoxicants and placed Garcia in custody based on field sobriety testing.

Garcia had a revoked drivers license, one prior conviction for operating while intoxicated, three outstanding warrants and two pending operating while intoxicated cases.

A 29-year-old passenger in the vehicle was also taken into custody on an outstanding warrant.

The five-year-old child was turned over to relatives.
