Former Whitefish Bay barber sentenced for molestation

MILWAUKEE (WITI) -- A former Whitefish Bay barber convicted of making his own child pornography while molesting local children will spend the next 38 years in prison.

David Foley is already serving 10 years in state prison for a check fraud scheme.  On Friday, a federal judge tacked on another 28 years for production, possession and distribution of child pornography, and for transporting a child across state lines to commit a sex act.

The U.S. Attorneys office had asked that Foley, who is 51-years-old, be sentenced to life in prison.  A presentence investigation recommended 30 years-to-life.  The judge gave Foley 28 years; however, he made the sentence 'consecutive' to the state sentence, meaning Foley will serve a total of 38 years in both state and federal prison before he is eligible for release on extended supervision.

Foley is a former Whitefish Bay barber who tried to use FOX 6 News to frame another man with child pornography.  In August of 2010, he mailed an unsigned letter along with a DVD full of child porn to FOX6 Investigator Bryan Polcyn.  The letter named another Whitefish Bay businessman as the person responsible for the contents.

After FOX 6 News turned over the disc to the Wisconsin Department of Justice, investigators traced it back to Foley.  The investigation also revealed that Foley had been molesting at least two local boys, one of whom he'd been paired with through Big Brothers Big Sisters, despite a lengthy criminal history.

The mother of one of those boys spoke at Foley's sentencing on Friday, along with the man Foley had tried to frame as a child pornographer.

If Foley serves the full 38 years, he would be nearly 90 years old when he is released.
