Benjamin Sebena to undergo second mental health evaluation

MILWAUKEE (WITI) – Benjamin Sebena, the man accused of killing his wife, Wauwatosa Police Officer Jennifer Sebena on Christmas Eve 2012, will have to wait two more weeks before he learns whether he is mentally fit to stand trial.

Sebena is accused of shooting his wife several times in the face as she left the Wauwatosa Fire Department while on duty early Christmas Eve morning 2012.

A court appointed doctor's mental health report, which was due Friday, June 7th, found Sebena was not suffering from mental disease or defect. However, the defense retained its own doctor for a second opinion and will be submitting a report by next week.

The defense also called into question the first few hours Sebena was taken into custody. We hear what was said inside the police station that day.

"Ben was crying, he had his hands on his head and said, 'She was helping me, she was always helping me. How could I do that?'" said Det. David Hoppe.

The state called witnesses who insist Sebena was always free to leave the police station prior to his arrest around 1 p.m. on that day.

"He wants to see his family.  He never once asked to leave," said Det. Hoppe.

Sebena sat quietly only answering questions from the judge with a few words.

Sebena will be due back in court Friday, June 21st.
