Town of Burlington man accused of downloading child porn

TOWN OF BURLINGTON (WITI) -- A 44-year-old Town of Burlington man is charged with 12 counts of possession of child pornography. The accused is Eleazar Hernandez.

According to the criminal complaint, investigators were monitoring a file-sharing network on November 1, 2013 -- and identified the IP address at Hernandez's home as one that had shared two files "believed to be child pornography."

Investigators executed a search warrant at Hernandez's home a week later and confiscated his laptop -- which included dozens of shared files. The complaint says "86 of the files in the shared folder were pornographic in nature and 12 of them were child pornography."

When first interviewed by investigators, Hernandez indicated he "did not search for child pornography and that the child pornography files would appear when he was searching for other files such as illegal music files."

Hernandez's computer was sent to the Department of Justice for analysis. The complaint says the analysis showed Hernandez was using search terms to find child porn.

During a second interview, the complaint says Hernandez "agreed that he was the person who downloaded the pornographic videos which were found in a shared portion of his laptop." The complaint goes on to say Hernandez "admits to having it and that he would accept responsibility for the videos."

If convicted, Hernandez faces up to 25 years in prison and $100,000 in fines. He is scheduled to be back in court for a preliminary hearing on April 30th.
