Own a pair of Vibram FiveFingers shoes? You could be eligible for a refund!

MILWAUKEE (WITI) -- Own a pair of Vibram FiveFingers shoes?

If you purchased them after March 21st, 2009 -- you could be eligible for a refund!

Vibram USA -- the company that makes the FiveFingers running shoes has agreed to settle a lawsuit that alleged the company made false and unsubstantiated claims about the health benefits of its glove-like footwear.

The class action lawsuit was brought in March of 2012 and was filed in Massachusetts -- where Vibram's headquarters are located.

Subsequent suits were filed in California and Illinois.

If you have a pair of FiveFingers -- you could receive a refund if you submit a valid and completed claim form.

Vibram will deposit $3.75 million into an escrow account and those funds will be distributed to those who have purchased a pair of FiveFingers between March 21st, 2009 and the date of the first dissemination of summary settlement notice or class notice, whichever is earlier.

FiveFingers will award up to a maximum of $94 per pair -- but people should expect to receive between $20 and $50 per pair.

Consumers can submit a claim for up to two pairs of shoes -- without any kind of receipt or proof of purchase -- but Vibram can request proof of purchase if they choose.

If you're looking to receive a refund on more than two pairs of shoes -- you must submit a proof of purchase.

If any of the $3.75 million remains, it will be donated to the American Heart Association for research on the health benefits of running.

On its website, Vibram says: "Vibram S.p.A., Vibram USA, Inc. and Fila USA, Inc. have entered into a settlement agreement resolving a patent infringement lawsuit filed by Vibram against Fila on July 6, 2011 in the U.S. District Court for the District of Massachusetts.  The lawsuit involved Vibram’s U.S. Patents No. 7,805,860, D579,181 and D582,134, and certain of Fila’s Skele-Toes footwear models.  While the terms of the agreement are confidential, Vibram’s patents remain valid and Vibram will continue to vigorously protect its intellectual property and enforce its patent rights."

Vibram is required to establish a website relating to the settlement of this lawsuit -- and also, to help customers who would like a refund.

That website is: FiveFingersSettlement.com. It has yet to be filled in by Vibram -- but those looking for a refund should be sure to check back often!
