Senate approves bill that would make 'upskirting' a stand-alone felony in Wisconsin

MADISON — The Wisconsin Senate has approved a bill that would make upskirting a stand-alone felony.

Current state law doesn't address upskirting, the practice of secretly taking a photo of someone's genitals, buttocks or breasts. District attorneys typically prosecute it as a misdemeanor invasion of privacy. The bipartisan bill would make upskirting a felony punishable by up to 3½ years in prison.

The Senate approved the bill on a voice vote Tuesday, October 20th.

The Assembly passed the proposal on a voice vote back in January.

The measure goes next to Gov. Scott Walker for his signature. Walker's spokeswoman didn't immediately respond to an email seeking comment on whether the governor supports the measure.

FOX6 Investigator Bryan Polcyn was the first to expose the weakness in the state's privacy law that prompted lawmakers to take action.
