Court reinstates force lawsuit against Kenosha police

MADISON — A state appeals court has reinstated a police excessive force lawsuit against the city of Kenosha.

Daniel Wilson filed a lawsuit last year alleging Officer Susan Webb injured him when she arrested him in May 2011 during a domestic dispute. He alleged she dragged him into a squad car and pushed him inside even though he had warned her he had just had back surgery.

A circuit judge granted the city's motion for summary judgment this past March. The 2nd District of Appeals reversed that ruling Wednesday, saying Wilson probably doesn't have a strong case but when the evidence is viewed in a light most favorable to Wilson the facts of the case aren't settled.

The city's attorney didn't immediately return a voicemail.
