Court documents: Man who shot officer may have had accomplice; gun purchased at Gander Mountain



MILWAUKEE -- New court documents show an armed robbery suspect, accused of shooting a Milwaukee police officer before he, himself was shot and killed may not have been alone. Unsealed search warrants have given us a better picture of the officer-involved shooting that happened near 73rd and Mill Road on Thursday, May 5th, and how the convicted felon got his hands on the gun.

"I just heard plenty of gunshots...boom, boom, boom, boom," Alonzo Low-Smith said.

"I closed the door and I got on the floor and stayed down there," a witness said.

Police say this all began when 38-year-old Burt Johnson robbed an O'Reilly Auto Parts store wearing a mask, armed with a gun.

Police say Johnson shot an officer in the chest, whose life was saved by his ballistic vest. Officers then fired back -- killing Johnson.

New documents reveal Johnson didn't act alone at the O'Reilly store. According to a search warrant, another masked man armed with a gun held up employees and one customer, helping to steal a little more than $400 from a safe.

The second suspect somehow got away.

Sources close to the investigation tell FOX6 News an 20-year-old is under arrest and could face charges of robbery and felony murder.

Court documents show a gun was recovered next to Johnson's body at the scene of the officer-involved shooting.

Gander Mountain store in Germantown



Investigators have learned it was purchased just 27 days prior -- at a Gander Mountain store in Germantown.

Police say a 30-year-old Milwaukee woman bought the gun, and an investigation is underway to determine whether it was a "straw purchase" -- bought for and given to Johnson, a convicted felon.

The woman who bought the gun hasn't been charged with a crime.

When FOX6 News stopped by her home, no one answered the door.

According to court documents, investigators asked Gander Mountain for surveillance video pertaining to this case to see whether Johnson was in the store at the time the gun was purchased.

A Gander Mountain representative told FOX6 News they are cooperating with police.

The Wisconsin Department of Justice’s Division of Criminal Investigation is leading the investigation into the officer-involved shooting.

The officers who fired in this case are 41 and 31 years old, respectively -- both males. One has 10 years of experience on the force, and the other has six years experience.

They were placed on administrative leave per policy.
