Misdemeanor drug case dismissed against former New Berlin West basketball coach

WAUKESHA COUNTY -- A misdemeanor drug charge filed against a man who formerly served as a basketball coach at New Berlin West High School has been dismissed as a result of a deferred prosecution agreement.

Foley appeared in court on Wednesday, June 22nd in Waukesha County.

Three misdemeanor charges were filed on February 20th, 2015:


    In September, Foley pleaded "no contest" to the possession of controlled substance charge, and the other two charges were dismissed.

    Foley was placed on probation for nine months as a result of the plea deal.

    In court on June 22nd, it was determined Foley has successfully completed a deferred prosecution agreement in this case -- and the case was dismissed.

    Foley was arrested in this case on February 6th, 2015 after a basketball game. New Berlin School District leaders told FOX6 News he was caught with marijuana on school property.

    After a short administrative leave, district leaders terminated Foley's employment. He also worked as a special education assistant at the school.

    In mid-February of 2015 came a new claim against Foley. A female teacher's aide said he bombarded her with text messages and emails -- wanting to start a romantic relationship with her.

    She ended up filing a restraining order against him.

    That case was dismissed in March, after neither Foley nor the woman showed up in court.
