"It`s probably one of the most stressful situations any police officer will find themselves in," Wauwatosa Police Chief Barry Weber said.

Weber said the officer feared for his safety and discharged his own weapon, striking the man.

The man was transported to Froedtert Hospital -- where he was pronounced dead.

The officer was not injured -- and has been placed on administrative leave.

Police say a gun was recovered.

Family members of the man who was shot were too distraught to speak on camera, but told FOX6 News his name was Jay Anderson, and he was 25 years old. His birthday was coming up in July, and fliers had been made for his birthday party. They say Anderson was a great father, and was kind and caring -- loved by many.

We're told Anderson and his family celebrated Father's Day in Madison Park, and they've been there for other family picnics.

However you want to spin it. It was 3am, he was in a park and made a bad decision. I’ll wait for the facts to come out before I pass judgement either way. Either way it’s pretty easy not to be shot by police if you do what they tell you. Common sense.

It doesn’t matter what the truth is. The black community will cry racism regardless of what ‘comes out’. They don’t have respect for law enforcement…… Look at the ratchet girl in Madison the other day…typical BS -the cops shouldn’t have to put up with. Everyone has an attitude, run their mouth, and when shots ring out, it’s ‘where’s da po-lice?’ And btw -it’s not racist or bigoted to speak of people in a manner that is truthful. You may not agree, but it doesn’t make it so because someone is offended.

  • Opinion8d

What a bunch of BS. It’s that mentality/’culture’ that has things like this happen. People don’t sleep in the park at 3am with a gun. And if I did, it should wouldn’t be anywhere near my hands that someone could see it. It’s NOT normal to be in the park at 3am by most standards. And odd that blacks always say the police harass them and are quick to shoot, but constantly put themselves in situations that just stupid!! Black man, in the park at 3am (park’s closed), with a gun that must have been visible, doing who knows what…..and yet people are surprised at the outcome?? Maybe you haven’t seen enough videos of cops getting shot in a split second by someone who seemed to be a non-threat.

  • Bean

Nope, Bryan. None of the good men in my life would be in a park at 3 in the morning with a gun. Sorry, but you lose.

  • Bean

And his CCAP case from 5/13/15 shows he’s been careless and dangerous with a gun before. Yep. Such a good man he was.

  • Angry Tosa Resident

I live across the street from Madison park, which is next to an elementary school, by the way, and there are drive-bys and gunshots nightly. The police have finally started patrolling the neighborhood more, and I’m glad. There’s kids all over and these animals are behaving like, well, animals. Hell, just a few months ago the elderly gentleman down the block was carjacked in HIS DRIVEWAY by some thugs.

Milwaukee has a disease, and I for one am glad to see it getting cut out, one animal at a time.

    • Compassion

Angry Tosa Resident, where’s your compassion? A person’s life was taken….a mother now has to burry her child. Family members and friends of this young man are reading these posts. Please have a heart…. Words have the power to destroy or encourage. I understand you want a better neighborhood. I get it. But, please think about how you would feel if your loved one was killed (rather justified or not); and then imagine seeing them being called an animal? You and your family were created by the same God who created this man. I’m sorry about the elderly man who was car-jacked. It’s really sad that he can’t enjoy life in his old age without being attacked for what belongs to him. But, what’s even more sad is that you think your words of hatred are better than the crimes of the thugs. Your words are as deadly as their actions. Use love to fight hatred….pray for them all.

You don’t know why this all went down so don’t be so quick to judge. First you sound like you’re not judging and then you quickly have to turn it around and make it about your constitutional rights. You are beyond asinine.

    • Ashanti

And what exactly is putting yourself in a situation to get shot? Sitting in your parked car alone, with your registered gun in a right to bare arms state? walking home from the store? being handcuffed and unharmed? driving whole black? Just to name a few ways African Americans have been KILLED by the hands of the “Law”.

  • Jessica Tibley

Parks close at 10p in ‘tosa if I remember right. Why is this dude there at 3am with a pistol?

  • Clinton

Hey bib baby moron, the park is closed at 3:00am so what was this guy doing in the parking lot armed? The Officer had every right and it was his duty to investigate the situation. Bottom line if the suspect complies with the Officer’s commands he is still alive today. No Moron Officers don’t just shoot people because they see a gun.

  • Bean

Nope, the cop already had the final say.
And CCAP tells us all what this joker was like…paints a very clear picture, so don’t keep saying what a good man he was. You’re wrong.

  • Mark

fair is fair. That’s kind’ve the rule thugs in Milwaukee live by. Ive got a gun. Give it up or I’ll simply shoot you for no reason. Sucks when the tables are turned huh.

  • chris

You’re are obviously an idiot when it comes to police procedure. I’m guessing that when faced with an armed person the officer should 1st try to reason with him, then use hands, then use baton/pepper spray and taser then his gun. If parks are closed at 330 am I’m sure the spotlights, overheads and guy in uniform might give a normal person the impression that it’s the police.

  • chris

Or he could’ve been making a drug deal or waiting to do so. He also could’ve been suicidal and escalated to suicide by cop.

  • head hunter

concealed carry is just what it means , not holding in your hands in stores, when you take the class you will know that if you are carrying a concealed weapon keep your hands on the steering wheel

  • head hunter

if i have a fight with my baby mama i dont go to a park and curl up with a gun, if he was so popular like on that poster why didnt he go to a motel or a friends house? it is funny that when people bring up good points you people always say it is racism!!!!

  • sparkles

TO BAD TO SAD. HE WAS IN A PLACE AT THE WRONG TIME AND HAD A GUB IN HIS VEHICLE, COPS DID THEIR JOB. ANOTHER THUG GONE. KUDOS TO THE WAUWATOSA POLICE DEPARTMENT. BETTER THAN THE CITY OF MILWAUKEE,

  • sparkles

Take a look on the internet. Try Fox six news or WTMJ Milwaukee. What do you see??? All of the news reports are car thefts , car thefts by force. Most of these thugs use force by weapons if you were a victim you might think differently,

  • Bean

Wake up, Susan…he’s not innocent. And look up his record online. That shows you what kind of ‘man’ he was.

    • Latrell

He was a family man and im sayin this because i know him you dont know him none of you know him

  • Hillary is a HE-devil!!

Black on black homicides are what 80% of all the homicides, yet many (not all) in the black community,or Mayor McTrolley and Chief Wiggum will admit that! Sheriff Clarke is the ONLY one with guts to tell the TRUTH to the public!!!

  • michaelwilliams851

This incident happen at approx. 3a.m. so this caring Father should have been at home with is fun protecting his family if anything had happen there 🔫 Nothing good happens after Midnight 🌛

    • tiredofwhiteracistfools

Michaelwilliams851 it doesn;t matter what time it was no one has the right to murder a person for him sleeping in his car!

  • Bean

So that he was found guilty of ‘Endangering Safety by use of Dangerous Weapon (Under The Influence of Intoxicant)’ just last year can be ignored? I don’t think so.

  • Bean

Just last year he was found guilty of Endangering Safety by use of Dangerous Weapon (Under The Influence of Intoxicant)…that says a lot about his character, don’t you think?!

  • ubiquitous libertarian king of beavis

If you point out all the black crime in this city (or anywhere) YOU ARE A RACIST!!! Even though the facts prove it’s true.

    • Wow

I think everyone is judging too quick here. He may not have been a thug, gangster, or dope dealer. He may have fallen asleep in the park. He may have even been a ccw permit holder. That being said, that doesn’t mean he didn’t do something very stupid to have the police officer shoot him. So let the investigation happen. Soon enough everyone will know what happened.

  • tiredofwhiteracistfools

Now, what we’ve been doing is looking at the data, and we know that police somehow manage to deescalate, disarm and not kill White people everyday. So what’s gonna happen is we’re gonna have equal rights and justice in our country or we will restructure their function and ours.

  • tiredofwhiteracistfools

This award; this is not for me, this is for the real organizers all over the country – the activists, the civil rights attorneys, the struggling parents, the families, the students that are realizing that a system built to divide and impoverish and destroy us cannot stand if we do. It’s kind of basic mathematics: the more we learn about who we are and how we got here, the more we will mobilize. Now this is also in particular for the Black women in particular who have spent their lifetimes dedicated to nurturing everyone before themselves. We can and will do better for you. Now, what we’ve been doing is looking at the data, and we know that police somehow manage to deescalate, disarm and not kill White people everyday. So what’s gonna happen is we’re gonna have equal rights and justice in our country or we will restructure their function and ours.
Yesterday would have been a young Tamir Rice’s birthday so I don’t wanna hear any more about how far we’ve come when paid public servants can pull a drive-by on a 12-year-old playing alone in a park in broad daylight, killing him on television and then going home to make a sandwich. Tell Rekia Boyd how it’s so much better to live in 2012 than it is to live in 1612 or 1712. Tell that to Eric Garner. Tell that to Sandra Bland. Tell that to Dorian Hunt.
Now the thing is though, all of us in here getting money; that alone isn’t gonna stop this. Dedicating our lives to getting money just to give it right back for someone brand on our body, when we spent centuries praying with brands on our bodies, and now we pray to get paid for brands on our bodies? There has been no war that we have not fought and died on the frontline of. There has been no job we haven’t done, there’s no tax they haven’t levied against us, and we’ve paid all of them. But freedom is somehow always conditional here. You’re free, they keep telling us, but she would have been alive if she hadn’t acted so… free.
Now, freedom is always coming in the hereafter, but you know what though, the hereafter is a hustle. We want it now. And let’s get a couple things straight, and this is a little sidenote: the burden of the brutalized is not to comfort the bystander, that’s not our job. Stop with all that. If you have a critique for the resistance, for our resistance, then you better have an establish record of critique of our oppression. If you have no interest in equal rights for Black people, then do not make suggestions for those who do. Sit down.
We’ve been floating this country on credit for centuries. And we’re done watching and waiting while this invention called Whiteness uses and abuses us, burying Black people out of sight and out of mind while extracting our culture, our dollars, our entertainment like oil, black gold, ghettoizing and demeaning our creations, and stealing them; gentrifying our genius and then trying us on like costumes before discarding our bodies like rinds of strange fruit. The thing is just because we’re magic doesn’t mean we’re not real.

    • You are so blinded by racism and hate you can't even see.

Actually you are the racist one here blaming all the problems of Black people on White people. If you look at the records by FAR more Black people are killed by other Black people than by White Cops, or even White people in general. Quit spreading your hate speech and spend your attention to where it should be, raising your kids and your community in a respectful way to get along with society not to demand society change to your liking. The key phrase is “melting pot”.. which means your rights blend with ours, your rights do not trump anyone elses.
I highly doubt this young man was in the park sleeping, because of the history of that particular park and parking lot he was either there selling or buying drugs instead of being home with his family like a “good father and son would be doing”… If you take a truthful serious look at society today, racism is by far more prevalent in Black culture than in White culture. Take your hate mongering elsewhere.

      • Shayla

So because there have been instances where blacks have killed other blacks that makes it ok for white cops to kill any black person whom they see fit? That is not justifiable at all! Someone who is sworn in to protect and serve citizens should be held at a higher standard, and not take it upon themselves to kill without reason. & yes, racism is more prevalent in black culture then white culture, but that is due to a history of enslavement and unfair treatment to blacks. NOTHING NOTHING NOTHING justifies a police officer killing an unarmed man, whether black OR white. And that’s just point blank period!

  • Solozzo

All I see is black killing blacks and carjacking black and white people. How’s that community organization of unwed baby momma’s with unlimited snap benefits popping out extra beneficiaries working out for you folks. Slavery ended long time ago and NO it’s not racism that fuels the inner city rage. It’s the broken families. Like 75% of ya’ll don’t have a daddy to control your inner city thug rapper black cult mentality. Decent White and Black folks don’t agree with this community organized crime syndicate against the taxpayer’s ya’ll are running.

    • Latrell

Naw not at all im pretty sure know one wud call him at 3:00 in the morning talkin bout meet me at the park i want some drugs

  • #devilinthedetails #NancyGrace

We simply don’t have enough info….Coverup? The way the facts of this story have been released lead me to believe this is a story that will be swept under the rug. Where is Nancy Grace? If this guy pointed his weapon, the cop had the right to fear for his life. However, that fact is not mentioned. We are only left to believe that this guy was sleeping on the park and the cop was scared when he saw the gun. Instead of waking this guy or calling for backup, he decided to kill him. Being a police officer is not an easy job and I respect the good ones. The police should release more info, so we know what happened here. Should be pretty easy to determine if this guy was a real threat or not. Scared cops should get out of the field and gun owners should be smarter too. Too many questions remain to pass final judgement. Shame on the news outlets for not demanding more info for the public and not pushing for accountability. I seeing a lot of typical racist comments, which doesn’t surprise me. Shame on you all. No need to say much more to people who are lacking so much!!

  • readingunderground

Milwaukee police are leading the investigation?! Gee, can’t see how that can go wrong. Especially considering how scary it must have been, a guy actually sleeping in his car. Apparently, it’s a thing now, and anyone in the driver’s seat is subject to immediate execution. Beware motorists, awake or sleeping!

  • Kirk

Problem is there nobody in the argument you believe. You don’t believe he was doing anything good in that park at three AM, and nobody believes the police didn’t throw that gun down after the fact.

  • Kirk

Love how the police body cams are alway out of batteries or became disconnected during the event, or minimally obstructed by their hand. They practice obstructing the cam.
