Police: 10 arrested in area near 44th & Auer after crowd asked to disperse

MILWAUKEE -- Milwaukee police say 10 people were arrested for disorderly conduct and resisting an officer in the area near 44th and Auer Tuesday night, August 30th.

This, after police asked a crowd in the area to disperse.

Police said in a statement Tuesday night MPD and local elected officials received complaints about crowds gathering in the area. Residents of Milwaukee Sherman Park neighborhood asked for assistance to restore order to the neighborhood.

On Tuesday around 8:00 p.m., MPD asked a crowd of about 30 to 40 people gathered in the area to peacefully disperse when officers observed violations of the law.

After waiting approximately 20 minutes, the crowd was again asked to leave.

Police say some of those present left the area, but others refused to leave. MPD began to make arrests.

Police say some in the crowd became disorderly and resistive and were also arrested.

As of 9:45 p.m., police said the area has been cleared and MPD continues to patrol the area.

The intersection at 44th and Auer is where 23-year-old Sylville Smith was shot and killed by Milwaukee police on August 13th.

    If it was a peaceful assembly, then what law was broken? The article doesn’t say anything about a lack of peace or the presence of violence. Are the police just arresting people and then letting the charges get dropped later?

      Sam, how would you like to live on that street and have 40 people milling about, blaring loud music, cursing and acting like fools all night long. The residents deserve peace and quiet.

    Nothing in this story suggests there was chaos of violence. Many are just assuming that because of past events and the fact that people were arrested. The truth is that, even if there is no “unrest”, if police don’t like the look of or reason for a perfecrly lefal peaceful assembly, they will arrest as a method of control. Knowing that the charges won’t hold and will be dropped later. Now, for one moment, ask yourself if you’re really ok with that. Are you really ok with them arresting people just to control their behavior, even if it’s legal? Think of the last time you participated in a legal group activity and imagine that the police decided it was not acceptable and did this. Would you really be ok with arrests at a youth sport event to disperse the parents? At a picnic at a County Park? At a tailgate event? At a neighborhood garage sale? At your child’s graduation celebration bbq in the back yard? Because if you are OK with what happened last night, then you are saying that it is acceptable anywhere to anyone.

      First, I know it is a short article, but you need to re-read it and actually understand the law. It says, Police received complaints about large groups gathering. That gives the Police every right to be there. Also, while everyone has the right to peacefully assembly, you need to have the proper permits, which is something they forget EVERY TIME in Milwaukee. Therefore they are illegally gathering and causing a disruption to the neighborhood and can therefore be arrested for disorderly conduct. So yes, most rational people who want their neighborhoods to be quiet and peaceful are ok with this. Baseball games are in designated areas, picnics are in designated areas, garage sales are on private property during the day when some commotion is expected. You are trying to compare things that are not even close to the same just to try and make an irrational point. Try to be a citizen of society and not a citizen of hate.

    As a Black lady and one who lived in that neighbor hood, I fee so much sadness and shame. We were able to go outside and play, go to the park and play with no problems. Now it really does not matter if its the day or night you could lose you life. I think Sherriff Clarke should keep closing the park at 6:00, the Mayor has no clue of what’s going on, he should have kept the curfew, but because of pressures from the black (vote) community he lifted it. Someone in Milwaukee needs to grow some (balls). I had a good childhood and this is something my grandkids will never have.

    Its too bad there is no historical book covering the entire history of the Sherman Park area since the 1800s. Clues to the history are in the property records. This area was ahead of its time with some of the states first black property owners and college graduates.

    The builders of Sherman Park were mainly French not German. They were much more liberal, accepting of diversity. It was the French Jesuit missionaries that supported black home ownership. Père Marquette’s legacy. Peace.

    There is a chance that the group was getting together to go over the upcoming school year and to develop study groups. Once school is in full swing, there should be no issues as they will be home studying by 9 pm.

    I really appreciate the way the author mentioned that the police were requested by members within the community to help restore order within the community. This is a great example of a neighborhood partnering with law enforcement. We need more news articles that highlight this as opposed to further dividing communities.

      Tiffanie, yes. It was great that the good people that live there did some bud nippin. There are plenty of parks to meet at, or since i’m guessing this was brought about by social media, they could have met in someone’s yard or home. There is only one reason to meet as they did-intimidation. Trying to say hey you all just stay inside while we run your blocks. As ChattiPatti said day or night you could lose your life. The good people working with GOOD community leaders and the PD will start to curtail this nonsense and enjoy their neighborhood once again.
