Could more have been done to protect Zina, Azana employees before shooting?

BROOKFIELD -- Three employees of the Azana Salon & Spa were killed when 45-year-old Radcliffe Haughton entered the salon and opened fire early Sunday afternoon, October 21st. Four others were injured. One of those killed was Radcliffe's wife, Zina Haughton. Following the shooting, some are wondering whether more could have been done to prevent it.

Tuesday, the owner of the Azana Salon & Spa spoke out for the first time following Sunday's shooting.

"Our hearts are broken over the loss of our colleagues. Buildings can be restored, equipment can be replaced, but the human loss can never be measured. The impact on the human spirit cannot be underestimated," Tami Gemmell said.

Following the shooting, some have wondered whether Gemmell could have taken any action to prevent Zina Haughton from being targeted by her abusive husband Radcliffe Haughton at work.

Employment lawyer Scott Luzi told FOX6 News despite some salons in southeastern Wisconsin having a policy prohibiting employees involved in domestic violence situations from coming to work -- legally, even if a boss knows about an employee's personal problems, there is little he or she can do to stop the employee from coming to work.

"The employer has no legal way to force the employee to leave if (the employer) knows about certain issues going on with the employee off duty. When it comes to employer/employee relationships, there's nothing (the employer) can do to prevent something like this from happening -- specifically under the employment law," Luzi said.

As for co-workers who may have felt unsafe and wanted Zina Haughton removed from Azana, Luzi said: "Legally speaking, no real leg to stand on."

A spokesman for Gemmell told FOX6 News Gemmell did not know about any of the domestic violence issues, although according to a police report, Zina Haughton's husband allegedly slashed Zina's tires in the Azana parking lot earlier this month.

The spokeswoman would not comment on whether Azana had any sort of policy regarding domestic violence and employment.

Gemmell herself did not answer any questions about the shooting incident following her brief statement Tuesday.
