Daniel Schmidt sentenced to four years in prison for child porn

WAUKESHA -- A 21-year-old Waukesha man was sentenced Monday, December 3rd for possession of child porn.

Daniel Schmidt's parents asked the judge to be lenient with their adopted son, during Schmidt's sentencing hearing. 

"I do think Daniel made bad choices. They were wrong, and I do not approve of what he did. This is not the son I know," Jean Schmidt said.

"I will do whatever it takes at any cost to provide support for my son," Ronald Schmidt said.

Schmidt also spoke during his sentencing hearing -- apologizing and saying his actions were awful and there are many who will never understand what he did.

In March, Waukesha police officers searched Schmidt's phone during a drug search. They found incriminating text messages that had nothing to do with controlled substances.

"In one text, he actually bragged that he had 'so much child porn, it was ridiculous,'" Prosecutor Debra Blasius said.

Prosecutors had asked for a six-year sentence. On Monday, Schmidt was sentenced to four years in prison for possession of child pornography and eluding police. The judge said despite Schdmit's young age, he still considers him "a predator in the community."

Schmidt still faces trial in Milwaukee County for performing sexual acts with a 13-year-old boy. 

"Now that we know the sentence in this case, there will be ongoing attempts to try to discuss settlement of that case and we'll have to address that here in the next couple weeks," Schmidt's attorney, Julius Kim said.

Schmidt's Milwaukee County trial is set to begin in February.
