Hooper sentenced to probation for not reporting child's death

WAUKESHA COUNTY (WITI) -- The man whose wife killed their 10-week-old baby will serve probation. Kevin Hooper accepted his punishment, but said his actions were misunderstood.

Hooper's wife was committed for life due to reasons of mental disease for the brutal murder of the couple's 10-week-old child.

Facing misdemeanor convictions, 34-year-old Kevin Hooper pleaded no contest to obstructing an officer and failing to report a crime.

The state said Hooper did not try to deceive law enforcement officials back on September 15th, when his wife, Dana brutally murdered their child, and said Hooper did not try to cover up the baby's death.

"This law came about in the state of Wisconsin as a result the infamous case in Florida involving a defendant named Casey Anthony,"

All sides agreed this was not a case of Caylee's Law, but a lapse of judgement.

"I thought about what would I do if I were in that circumstance and I don't know. I don't know. Anybody knows. What a horrible thing to be faced with,"

Hooper's attorney pleaded to the court to put themselves in his client's shoes. Hooper said the reason he didn't call police right away was to shield his two other children from this horrific crime.

"He called his father-in-law. He got Dana admitted -- called his father-in-law and said 'I need you to come to the house right away,'"

Hooper said in hindsight, what he may have done was wrong.

"I am at peace knowing that I tried to do what I thought at the time was the right thing for my family and for that I am truly blessed," Hooper said.

Hooper was sentenced to probation for two years. His conditions are pending what happens in juvenile court next month.

Hooper's visitation rights to his children are limited. If he were to violate conditions set by the juvenile court, he could serve prison time.
