Family of teen killed by falling concrete reaches partial settlement



MILWAUKEE (WITI) -- Three years after a slab of falling concrete killed 15-year-old Jared Kellner, a partial settlement has been reached in the case.

Kellner was walking to Summerfest on June 24th, 2010 when a 13.5 ton decorative panel came crashing down from the O'Donnell parking garage. Kellner's friend, Eric Wosinski, and Wosinki's mother, Amy, were injured during the incident.

The concrete panels have long since been removed from the parking structure and while officials investigated several reasons the panel may have fallen, lawsuits were being filed.

Attorneys say a settlement between the victims and Findorf, the company charged with supervising the installation of the decorative panels, has been reached, although it is not clear how much the settlement is for.

The case against others involved is still ongoing -- including claims between Findorf and Advanced Cast Stone, the company responsible for attaching the panels to the ramp -- as well as suits against Milwaukee County.

Advanced Cast Stone has requested to see emails between engineers and county employees regarding what was known, and when, about the panels. Milwaukee County says the emails are privileged information and should not be disclosed.

A retired judge will be appointed to look over the documents and decide whether or not they will become part of the case.

A jury trial is scheduled for October 6th.
