Grandmother faces homicide charges in co-sleeping death of 11-week-old

MILWAUKEE (WITI) -- A Milwaukee grandmother is facing homicide charges for allegedly getting drunk and then sharing a bed with her 2-month-old grandson. Its the first time in 5 years that Milwaukee prosecutors have charged an adult with a homicide after a co-sleeping death.

It's probably safe to assume that Sheree Wimberly had no intention of rolling over and smothering her 2-month-old grandson, K'Dyn Carson, back on October 16th.

But according to court records, her decision to get drunk on vodka and then share a bed with a child was more than just reckless, it was homicide.

The 45-year-old grandma allegedly told police that she and her two adult daughters shared 2 1/2 pints of Amsterdam Vodka before going to bed. Sheree was drinking hers straight.

It was just after 2:30 a.m. when the baby's mother woke her up, yelling, "Momma, you laying on Ky'Dyn! K'Dyn's not breathing! He's dead!"

"You're relying on all these individuals int he home to be honest about what took place," said Assistant District Attorney, Matthew Torbenson.

Last summer, Torbenson told FOX6 Investigators that honest witness statements are hard to come by, because relatives don't want to see loved ones get in trouble.

Earlier this week, another Milwaukee infant died while co-sleeping with his mother and father on North 25th Street.

In that case, there are conflicting accounts about whether or not alcohol was involved.

But Wimberly admits she was drinking.

"She informed me of longstanding substance abuse issues," said Torbenson.

Four and half hours after the family called 911, and eleven hours after Wimberly went to sleep, her blood alcohol level was still above .08. Suggesting she wasn't just drunk when she laid down with baby K'Dyn -- she was hammered.

"I find probable cause that she committed a felony in Milwaukee County and I bind her over for trial," said Judge Dallet.

Wimberly is the first person charged with a co-sleeping homicide in Milwaukee County since 2009. She walked out of the courtroom Thursday, an accused killer -- free on a signature bond.

Around the time Wimberly returns to court next month, State Representative, Samantha Kerkman, plans to file a bill that would make intoxicated co-sleeping a crime, in and of itself.

She also wants to make it standard practice to test an adult's blood for alcohol and drugs after any suspicious infant death.
