Courtroom chaos as man taken into custody after plea: "Wasn't expecting him to get arrested today



MILWAUKEE -- There was chaos inside a courtroom at the Milwaukee County Courthouse on Monday, November 2nd. A man facing charges for armed robbery and spitting on an officer was in court for a plea deal, but his guilty pleas weren't what set him off. There was an outburst in court as the judge ordered the man taken into custody following the plea.

According to family members of 21-year-old Rafael Hernandez, he didn't expected he'd be taken into custody following the plea hearing -- and his five-month-old daughter was waiting for him just outside the courtroom.

The man entered two guilty pleas in court on Monday -- and then, resisted deputies trying to take him into custody. As deputies tried to get his hands behind his back, Hernandez yelled that his baby was in the hallway, and that he suffers from seizures.

The plea deals were entered in connection with two separate cases -- one for armed robbery. A criminal complaint says three suspects were involved, but it was Hernandez who pulled out a shotgun and ordered the victim to hand over his laptop.

Hernandez was charged with throwing/discharging bodily fluid at an officer in a separate incident -- accused of trying to bite the man, and then spitting in the officer's face.

Hernandez came to court alone Monday -- with his five-month-old daughter in a stroller. During his plea hearing, his baby was watched by an intern with the Milwaukee County District Attorney's Office.

Family members arrived within an hour following the outburst to pick up the child.

"We wasn't expecting him to get arrested today and I guess he flipped out over the baby," Evelyn Hernandez said.

Evelyn Hernandez is Rafael Hernandez' sister. She says there was no one else who could have watched the child on Monday. Evelyn Hernandez says the baby's mother had a doctor's appointment and couldn't take the child.

"We was not expecting him to do any of this. I never heard of him doing stuff like this, especially in court," Evelyn Hernandez said.

The district attorney did not ask that Hernandez be remanded into custody Monday pending his sentencing hearing -- but the judge explained that it's his policy to remand after a conviction in armed robbery cases -- especially when dealing with the actual gunman.

Hernandez will be sentenced on December 8th.
