Latinos vs. Leon’s: Is the frozen custard stand’s “English-only” policy discriminatory?

MILWAUKEE -- Leon's Frozen Custard has an English-only policy -- a policy some are questioning, and others are applauding. The policy has one group calling for a federal investigation.

Ron Schneider, the owner of Leon's, says there's nothing wrong with his policy, and it doesn't appear that it is hurting his business.

Leon's is located near 27th and Oklahoma on Milwaukee's south side.

"Most people that live here are Latino," Jorge Maya said.

Leon's Frozen Custard is a Milwaukee institution -- but some Hispanics are upset over a company policy that was recently discovered.

"I don`t think I`m going to be back anytime soon," Maya said.

This all started on Tuesday, May 17th, when Joey Sanchez overheard one of Leon's employees interacting with a Spanish-speaking customer.

"She whispered to him in Spanish 'I`m not allowed to speak Spanish to you,'" Sanchez said.

Sanchez was next in line. He also placed his order in Spanish. The employee gave him the same response.

"I`m trying to understand or find the why. I need to hear from him to hear why he has this policy," Sanchez said.

Schneider told FOX6 News his employees can only speak English on the job.

"Hey, c`mon! It is America. We`ve spoken English for a long, long time," Schneider said.

Schneider says the policy has been in place for a decade, and it has never been an issue.

"Any foreign language is going to be a problem. What I`m trying to avoid is when people come up here, get waited on in a different language because there happens to be an employee who speaks that language," Schneider said.

Sanchez said he feels Leon's policy is just bad business.

"If they have the people who can speak Spanish and communicate with the customer better, why not?" Sanchez said.

Other customers said they side with Schneider.

"We do live in America, you know?" Ryan Schmidt said.

Schneider says no customer has ever been turned away at Leon's.

"It`s going to get disruptive if we have to become bilingual, trilingual or anything else," Schneider said.

FOX6 News asked Schneider if an employee would face disciplinary action if they spoke another language. He said they would expect a chat with the boss, but they likely wouldn't be fired.

Schneider also pointed out that his wife is Hispanic.

The Leauge of United Latin American Citizens (LULAC) is calling for a federal investigation by the EEOC into the policy at Leon's.

Below is a statement from LULAC of Wisconsin State Director Dr. Arturo Martinez:

"In the last 24 hours, LULAC of Wisconsin has received numerous requests to investigate the issue of workplace policy as it pertains to language at Leon's Frozen Custard located at 3131 S. 27th Street in Milwaukee, Wisconsin. While many of us consider this as a community institution, it was surprising when we learned of their language policy, which is in clear violation of federal labor law. Upon reviewing the statements made by management in a video interview detailing Leon’s policy, we are requesting an investigation of this policy by the United States Equal Employment Opportunity Commission. The law is clear on this issue and offers few exceptions. In the meantime, we encourage management to review their current employment policies with counsel to bring them into compliance. We are confident that in doing so, it will lead to a stronger business and a stronger community.”

    I get what you’re saying but Ithink he’s had people waited on in the past in other language that get pissed off if the next time they come there the bilingual person is not there and while think its silly to restrict people from speaking other languages.       My first job was at Leon’s. Worked with a lot of great people, some of who are no longer with us. There was never an issue then, why now? C’mon people, aren’t there bigger issues in today’s world? Someone posted it was a Polish neighborhood, and it was. Get over yourselves, this is just dumb!

      Americans are fortunate in that English is the business language of the civilized world. If you are a US Citizen, are you not suppose to have working knowledge of the English language. This is a private business and it is not discriminating against other “US Citizens”. People can choose to either shop there or not shop there. Just let the “free” market take care of it. Maybe one of the whiners should experience setting up their own custard shop across the street and begin to understand what it is like to run a business with all of the “help” we receive from the various governmental agencies, that look for every opportunity to meddle in our businesses and financially bleed us dry.

      You must be exhausted from all the conclusions that you jumped to. An owner that is bitter? Mono-linguistic people threatened? Marketable skills as a motivator for his decisions (reminder these are fast food workers)? Speaking multiple languages is a great skill. No argument there. Speaking it while being incompetent, uneducated and disrespectful … not so much. There are so many other skills that are far more valuable.

      If you want to argue that he is making a poor business decision, go right ahead. I won’t even disagree. He may be missing out on a potential marketing opportunity to serve customers. But, that is his prerogative. If you want to argue that the government should be involved in policies about language speaking, I will campaign against that lunacy as fast as I can. The free market will take care of this. If customers are offended, they have other choices.

I happen to be very proud of the fact that I speak only one language and I do it very well. I don’t go to El Rey for the simple fact that I can’t understand anyone or read any of the labels on their food. Same with the Piggly Wiggly on Chase & Oklahoma. A little bit too hispanic to close to home in my opinion. But you don’t see me calling the Civil Liberties Union because I can’t read the People magazine in that store because it’s all in Spanish.         I do agree with your opinion that supporters of Trump, Clinton, Sanders and any political candidate are far more closed minded than ever before. We probably disagree on the reasons. You seem to chalk it up to closed minded bigotry and I would attribute it to a different definition of enlightenment, which was once based upon facts and is now based upon feelings. I have no requirement to accept your feelings or opinions about a subject as facts. I should be more open minded when facts are offered. There have been very few facts offered on this thread.
        I do find it unfortunate that there are so many bigoted comments here. That is sad. This is a great country. I don’t think people should be forced to learn English, but they should recognize that their life here can be improved if they choose to do so. That’s a choice.
        Back to the topic: Leon’s has made a bad business decision (opinion). There isn’t anything illegal about it (fact).

    Any business has the right to refuse service to any person for any reason, this includes speaking a foreign language. If a Mexican restaurant decided that they only allowed Spanish to be spoke it would be protected under the same law.

      Could you imagine if someone with an ICE uniform sat outside of Leon’s? There would be complaints about safe spaces and intimidation, etc. The south side is becoming little Mexico. Instead of Spanish language ads becoming less over time, it’s done the opposite. I’m all for legal immigration and taking hard working people. But don’t come here and wave the Mexican flag and not assimilate (i.e. learn the language!)

    The EEOC frequently assumes that English-only policies can be discriminatory based on Title VII national origin. Courts haven’t always agreed. A good defense, if it gets to court, would be that the owner only speaks English (if true) and he needs to monitor his employee’s interactions with the customers. Just my dos centavos.

    Good for Leon’s. My ancestors learned English when they migrated to this country and we’re proud to do so. The Latino community doesn’t hold this regard to assimilating. Based on this policy being brought to light I will definitely be stopping at Leon’s more often. America could save a lot of money being one language country. I do not expect to go to mexico and have them learn English because I refuse to learn Spanish, I would fully expect to struggle to communicate and not be able to provide a high quality of life due to the fact that I cannot communicate. Just common sense but America has become too sensitive and too PC and look how we have trended steadily downward since this all started in the early to mid 90’s

      Go to Montreal, Canada. They speak French and pretty much ignore you if you don’t. I was surprised the first time I went there for work and found out how cold they (store / restaurant workers) are to non-French speakers…..did I cry?? No, I made sure I went out with a local who could do the French speaking for me.
      The Canadian Business that my company was working to make a contract with had bilingual people there to translate.
      Maybe the spanish speaking people should go to Montreal and complain when the people speak only French to them……………

    Feel compelled to throw out some facts on this item. The policy the owner has had for English only has been around for 10 years. Why are people making an issue of it now? Because *one* person posted it on social media? This shop has been around for 50+ years in that neighborhood. The Neighborhood was not hispanic when the shop opened. To make this an issue for EEOC is absurd. There are no federal laws which state any other language besides English is official in the USA. This is a private business that has this policy as one of the employee rules, no different than showing up on time, being respectful, etc. Are any employees complaining about the rule? The customer was not refused service, so there is no discrimination involved. If the employee taking the order only spoke English, the customer would be in the same boat if they tried to speak Spanish. If you don’t like the policy, then don’t go to the business. There are way more important issues in the world that people should concentrate on.

    Nothing against Latinos but man my family came from Eastern Europe 10 years ago. I didn’t speak a word of English when I first came to U.S. I studied hard and learned the language and helped my parents to do the same. What bothers me the most is I know Latino people whom been living in U.S. a lot longer than I have some even born here and they don’t speak English. Learn the language of the country you live in.

    So to be a non discriminatory business owner in U.S. a business owner must speak at least top 10 spoken languages… WTF is this nonsense!?

      Yes it was but up until the Mexican immigration the vast majority of immigrants were proud to learn English. If you hate this country and our ways so much why live here? People do have options I know Mexico as issues with violence and job opportunities but so does America so I just don’t get why move here and refuse to learn the language. If I lived in Mexico I would he proud to learn Spanish and say I’m a true countryman and have learned to survive assimilate and become one with the others in my new country

    If I went to Mexico, Russia, China, or any other country would they be forced to learn my language or would I struggle to survive until I learned the language of the land? What seems lazy is people refusing to learn English in America, what seems racist is going to country and expecting everyone to change for me. Why wouldn’t people want to learn English in America and have a better quality of life? I think rants like yours our counter productive and this is an opportunity to have a true conversation about assimilation and a chance for all in our country to have a conversation about walking in step with each other for the greater good.     Leon’s violated no laws whatsoever. The 4 reasons given in EEOC’s own position statement explain why this is the case:

    The EEOC’s Position on English-Only Policies
    The EEOC recognizes that “the primary language of an individual is often an essential national origin characteristic.” 29 C.F.R. §1606.7(a). In scrutinizing English-only policies, the EEOC creates two separate categories. The first category consists of English-only policies that prohibit employees from speaking their native language at all times. The EEOC finds that this category of English-only policies can “disadvantage an individual’s employment opportunities on the basis of national origin” and “could result in a discriminatory working environment.” Id. For this reason, the EEOC presumes that such policies violate Title VII.

    The second category of English-only policies are those that require employees to speak only English at certain times. 29 C.F.R. § 1606.7(b). According to the EEOC, such policies are permissible as long as they are justified by “business necessity.” Id. The regulation does not define the term business necessity, but the EEOC’s Compliance Manual explains that an English-only rule is justified by business necessity “if it is needed for an employer to operate safely or efficiently.” The following are examples from the EEOC Compliance Manual of a “business necessity” that would justify an English-only policy:

    1. For communications with customers, coworkers, or supervisors who only speak English;

    2. In emergencies or other situations in which workers must speak a common language to promote safety;

    3. For cooperative work assignments in which the English-only rule is needed to promote efficiency; and

    4. To enable a supervisor who only speaks English to monitor the performance of an employee whose job duties require communication with coworkers or customers.

If we could come together as a country and get in step with each other we could be the best country in the world again.     Living in Florida, there are Latino businesses everywhere and most of them do NOT try to speak English. You have to take a Spanish speaking person with you or point to what you want so what is the difference? Also, most Latino companies here do not hire many Americans. Point is, run your business as you see fit as long as you are not denying service based on any type of discrimination. Leon’s is not denying service only asking his employees to speak English at all times. Just like businesses that accept cash only. Maybe he just doesn’t see the value in being bi-lingual.

    Veronica, it would behoove you to think outside the box you have become most comfortable with. You are approaching this issue as a worker, without considering it from a management perspective. I think you will learn that, upon review by the EOC, Leons has done nothing illegal. An employer must be able to oversee his/her workers. If he cannot understand them, then that is imminently more difficult. Allowing discussions in languages outside of thr one with which he is familiar prevents this. The only exception would be sign language, which is protected by disability rights. What’s the harm, you ask, in allowing languages you don’t understand? Well, then, who knows what is truly occurring in that discussion? Remember thr northside McDonald’s that was shut down after it was discovered that employees were selling drugs via the drivethru? What about sexual harassment? How can you ensure someone isn’t speaking inappropriately to a customer if you can’t understand what was said? Is it a better business move to be bilingual and allow your business to be bilingual. Sure. But it is not required. There is literally no law that requires businesses to communicate in more than one language. Nor should there be. Do you want to force the palettes to conduct business in English upon demand? That’s the irection such a law would be headed. That knife cuts both ways. It’s completely unnecessary. Give thr small business owner back the power over his own business. If you don’t like how he runs it go elsewhere. Forcing this nonsense doesn’t end it, it just drives it underground.

    Talk about hypocritical…Leon’s is taking heat and facing possible EEOC review for an English only language requirement. In response, Bounce Milwaukee is giving free ice cream to anyone who order in non-English today. So I can’t get free ice cream if I speak only English…because some people have trouble getting ice cream if they speak only Spanish? Time to request the same review for Bounce Milwaukee.

      I don’t really see this as a big deal. They made a business decision based upon what they believe will generate some customer loyalty and demand for their business. It’s a free market … people are free to protest and stop patronizing their business as well. That’s what makes this country great.

      For those interested, Bounce milwaukee has confirmed that they will not offer you the free ice cream deal if you order in English. I guess they are basically saying that they agree with the Leon’s concept that it should be up to the owner. So, Leons and Bounce Milwaukee have the same perspective.

You can’t even drive anywhere because the traffic is so heavy because of these idiots. They have 5 junker cars per family and they are on the streets all day with no jobs. Driving around.     I am not racist in any way but it all goes the same that if we learn Spanish, french, or even German you live here in the states your gonna have to learn to speak English to as something g simple as shopping at the mall, groceries, and even an ice cream cone. I understand you can keep your heritage but when you live in an English home you need to learn it. Just as if you were to move to Germany or spain, have to learn the language. Some of Latinos only men work or some dnt work at all and the ones who do work do they speak English? I would assume so to have a job to pay bills just like every one else so I see the understand that this shouldn’t be an issue just people making a stink bc they don’t want to or refuse as a stubern ass to learn English it’s our country home of the free and the brave we speak English this is our country and where you live like any one else you have to learn the ways to live and get by. Why we should things change so much when people don’t feel like at home or have to complain about everything.

    What you are saying is that every business in the country must be able to speak every language in the world. Think about it, I buy a product and the instructions are written in at least five different languages and the American English is worse because it is written by some non English speaking person in some other country. My grand parents were German and they learned and spoke only English as this was their adopted country, these people are refusing to learn the language of their adopted country. This custard stand is located in what was a Polish community and they didn’t demand that that this business establishment speak Polish, they learned English!

    I worked in a medical clinic where we saw Hispanics that were here for YEARS still refuse to speak the language of OUR country. YOU came to Ron Schneider’s neighborhood, not the other way around. If he wants to conduct HIS business in HIS country in OUR language, he has that right. Get over it and LEARN OUR LANGUAGE AND BECOME CITIZENS, OR GO BACK HOME. My neighbor did it. My mom did it. What makes you so special?
    We need people who will love this country as much as we do. Who will learn OUR language and give all of their allegiance to OUR flag and are willing to become citizens. We do not need parasites.

    or for goodness sake – point to your selection on the menu board. My wife & I travel world wide and we always make a respectable effort to learn the basic language of the country that we visit. And how long has this business been in this neighborhood??? ( rhetorical question) Really? – who set this guy up to cause all this commotion? Learn English, por favor, min fadlik, prosim, s’il vous plait, bitte, or bring your cell phone and use the translator. Go home and study!!!!!

    Leon’s is a wonderful place and has had many different types of nationalities living in it’s neighborhood – German, Polish, Italian, etc., and all without being offended by English because they learned the language. This is a predominately English speaking country and more than just Hispanics go to Leon’s. It’s also a private business and they should be able to run it the way they feel works best for them. Seems it’s been working fine for years. The owner has a right to know what his employees are saying to the customers, so I understand the emphasis on speaking English. I have a great appreciation for small business owners and how hard they work to make it on their own. Customers should simply bring someone with them that knows the language or go to another custard shop.

    I wonder why the customer that could speak both English and Spanish didn’t simply help the lady that didn’t speak English? Seems like it would have been the most considerate thing to do – helping out your own kind. I certainly would have done that and I know many others that would too. A little kindness goes a long way and sets a better example of how you want to be perceived.

    This is America. While many languages are spoken by people living here, Englush is the norm. Why should someone who can clearly speak English, want to place an order at a business in Spanish? He sure talked to the media in English. A small business that has been in business for over 70 years is now going to get hassled because of this?! It’s ridiculous. If u live in this country u should speak English. I would not go to live in another country & expect the citizens there to all learn English for me. I’m all for keeping ur native language & customs. But when u are dealing in public know the language.

    Being a USMC vet, I traveled to many countries. Every time I went to a country where their primary language was not English, I learned enough of their language to be able to communicate on at last a very basic level.

    If we start to mandate employers be able to communicate with the public in every language possible, there is no way this can be done. What if I want to order custard in some language like Klingon from Star Trek? If you cant talk to someone in a primary language of that country, bring your own interpreter. Why should we be expected to supply the interpreter? If you can’t conform to s, you’re the problem

Its unfair to the company to try to chance the rules. Will they have to have Hmong intrepeters / French speaking employees. When will it end.     Look up the requirements for immigrants to become an American citizen. Most naturalization applicants are required to take a test on English & Civics (U.S. history and government). So what the hell are you (media / FOX6) doing in trying to say the Owner of a Business who is an American citizen is discriminating against people who are obviously not American citizens. Freaking Liberal agenda makes me sick!

Why did he/she feel the need to tell the person ” I can’t communicate with you in Spanish” .. Looking for their 15min I guess……

    I grew up in that area, My family is of polish heritage and my grandparents and parents adapted to the language and customs. I would be far more understanding of a traveler from making a first visit, but these people live there, learn the language. When I traveled to Spanish speaking countries I learned their language. So come on “when you visit your neighbor knock on the door” if you plan on living in a foreign land learn the language. These people will just try to use the Feds to mussel a small business to get their way and then wonder why the non Latino population resents them.

    It is completely unreasonable for someone from another country to tell me what language I have to speak. THEY need to learn MY language to speak in MY country, just like I would have to if I went to another country. Saying otherwise means that they are either too lazy to learn it, they are too disrespectful of others to learn it, or they want this to be their country. No matter which it is, TOUGH!!!! Grow up and get a life – right after you learn the language and customs of the country you live in!

    It continually amazes me that immigrants that recently came to this country take more pride in where they came from instead of in the country they now choose to live in. If your freedom and your rights mean so much to you then maybe you should take pride in the country you live in that gives you these rights. A big part of that is learning the language!! To me when you speak your native language when you are out in public you are disrespecting the USA and it’s citizens. I’ve never seen a Caucasian employee Ina h of their establishments. The checkout girls only speak Spanish and refuse to speak to you unless it’s Spanish.     This is outrageous! These people are coming into this country and taking over like they own it! The American people, too many of whom are unemployed or work for minimum wage and can barely afford to take care of themselves or their families, still have to pay taxes for these people to be here. Our grandparents and great grandparents came to this country LEGALLY, I MIGHT ADD, and learned the English language. Illegals are being given more rights than the true Americans who pay their taxes and live here. This is truly unbelievable and should make ALL AMERICANS SICK!

    when i lived in another country, i used their language. it is about r e s p e c t. and what if my cambodian friend wants to order ice cream in khmer? are they going to have to hire a person that speaks it?! absurd.

    I think this is crap I’m latino and I live in USA for more than 15 years , If you want to live here learn english , if not just don’t come here , is not another country on the planet who will change their language for someone else language, Germans have documents in German , French same Chileans only in spanish , stop this people to complain about everything, I you can’t communicate just go to everyone speak your language, and I’m pretty sure this person will fail spanish test written and read because they just can’t speak none correct
