James Holmes to face judge on Monday in Aurora theater shooting

AURORA, CO (CNN) -- The man accused of gunning down scores of moviegoers at an Aurora, Colorado movie theater last summer, is expected to face a judge Monday, January 7th. At issue is whether there is enough evidence to require 25-year-old James Holmes to stand trial for what's been called one of the nation's worst mass murders.  

Just after midnight on July 20th, 2012 -- Holmes is accused of opening fire inside a crowded theater at Century Theaters during a midnight showing of the Dark Knight Rises. Homes is charged with killing 12 people and wounding dozens more. 

In court on Monday, prosecutors are expected to call scores of witnesses before Arapahoe County District Judge William Sylvester. He will determine whether the evidence is sufficient for Holmes to stand trial on more than 150 counts -- including murder, attempted murder and weapons charges.

The weapons included explosives allegedly used to booby-trap Holmes' apartment. 

Holmes' attorneys are expected to present a diminished mental capacity defense.

Holmes had been seeing a psychiatrist at the University of Colorado, where he was a doctoral candidate in neuroscience until dropping out in June. 

Holmes' attorneys say he was hospitalized in November after repeatedly banging his head into a jail wall.

Holmes' preliminary hearing is expected to last several days. The judge has issued a gag order, so this may be the first time the public hears much of the evidence against Holmes.
