10 months after allegations made against her, Nancy Evans not charged



FRANKLIN (WITI) -- Nancy Evans, the former warden of the Milwaukee Correctional Facility in Franklin is accused of giving thousands of taxpayer dollars to her boyfriend. 10 months after the allegations were first made, Evans faces no criminal charges and still has a job with the Milwaukee County Sheriff's Office.

FOX6 News profiled Evans over a year ago -- taking a look at how quickly she was able to rise through the ranks. She has now fallen just as quickly.

Now, despite being accused of unfairly granting government contracts to a boyfriend, she will not face criminal charges, and may not even be fired.

Evans had this to say when FOX6 News caught up with her in early 2012: "I'm very happy in my personal life -- in my professional life."

Months after that interview, Milwaukee County Sheriff's Office documents obtained by FOX6 News show a lengthy investigation into questionable practices by Evans at the jail.

The documents reveal that Evans funneled County money to Jevon Terry -- a man she admitted to having an extra-marital affair with for 10 years.

Investigators say Terry's company "Midwest Wood Flooring" was paid about $6,000 of County money by Evans for refurbishing 20 chairs, removing wall paper and painting and priming.

Investigators also found Evans ordered at least some of the work to be done by inmates, while she and Terry were away together on a trip to Reno.

A Milwaukee County Sheriff's investigators sought charges against Evans last year, including misconduct in public office.

The Milwaukee County District Attorney's Office declined to prosecute. In a statement, it said Evans did not obtain any "unlawful benefit."

Prosecutors also point out what Evans did was perhaps more in line with a Milwaukee County code of ethics violation. In other words, the DA's Office kicked the Evans case back to the Sheriff's Office.

A Sheriff's Office spokeswoman told FOX6 News the internal affairs case against Evans is still pending -- and Evans is no longer a major -- her rank when she was the warden.

Though as a simple search of the Sheriff's Office website shows, the office is certainly not hiding Captain Nancy Evans. The apparent punishment, or lack thereof, upsets Milwaukee County Deputy Sheriff's Association President Roy Felber said.

It's important to reiterate the Evans investigation is still pending, so her fate has yet to be decided. At this point, the District Attorney decided not to charge back in November, so the question becomes, when, if ever will Evans face serious discipline?
