Charged: 22-year-old Racine man accused of kicking police officer to the ground during his arrest

RACINE COUNTY (WITI) -- A 22-year-old Racine man is accused of kicking a police officer to the ground during his arrest. He is now charged with battery of a peace officer, disorderly conduct and resisting an officer.

On March 3rd, which just so happens to be Montavius Everton's birthday, police were called out to the 1200 block of English Street in Racine. There, they made contact with a woman who looked extremely nervous, and was pointing to the kitchen of a home in the area. Police walked toward the kitchen and made contact with Everton -- who became extremely loud, boisterous and vulgar, police say.

Everton was asked several times to calm down. Based on his state of agitation, police tried to secure him in handcuffs -- but police say Everton pulled away with extreme force.

He was eventually able to be detained in handcuffs -- but he continued resisting officers, according to the complaint.

As police attempted to remove Everton from the home, he's accused of kicking an officer several times in the lower legs -- causing the officer to slip and lose his footing. Police were eventually able to subdue Everton and place him in a transport wagon, but it took a large group of officers to do so.

Police spoke with the woman at the home, who reported Everton is the father of her child. That woman told police Everton called her on his birthday -- wanting to see his child. The woman said she picked Everton up at his grandmother's home, and she observed Everton put a fifth of Hennessey into the baby's diaper bag. The woman said she was worried Everton was drunk, and that he would start fighting with her.

When they got to her house, the woman says Everton started arguing with her and stated multiple times that he was "going to kick her (expletive)," according to the complaint.

The woman noticed it was time to go pick her son up from the bus stop -- so she left to go get him. Once at the bus stop, she requested the bus driver call police -- indicating she feared for her safety.

The complaint indicates the woman went back to the home because she had two other children there with Everton. Shortly thereafter, officers arrived.
