GERMANTOWN, Wis. - The Wisconsin Department of Justice (DOJ) Division of Criminal Investigation (DCI) is investigating an officer-involved critical incident in the Village of Germantown that occurred on the evening of Monday, Oct. 23.
Scanner: "Shots fired. The subject appears to be down."
"That’s when we heard the gunshots. There was probably about 5," said Kerry Horrigan.
Danger and chaos above led to fear and children hiding below.
"So we all went and we hid behind the curtain on the stage," Horrigan said.
The Department of Justice (DOJ) is piecing together a police shootout that happened on the roof of Kennedy Middle School in Germantown. The Monday night gunfire caused panic.

"There were all sorts of things going through my mind," Horrigan said.
Officials say at around 6:30 p.m. Monday, officers with Germantown Police Department responded to a report of a subject acting erratically in the parking lot of Kennedy Middle School. The male subject, with no known relationship to the community or school, was driving a vehicle with out-of-state plates that broke down and was at a nearby car repair business. A news release says the subject was acting erratically at the car repair business and departed there on foot.

"Our officers responded to the scene and immediately saw this individual gain access to the roof of Kennedy Middle School. Our officers were able to pursue once on the roof shots were fired at officers. The shots were exchanged," said Germantown Police Chief Mike Snow.

Police say the man died at the scene.
Germantown Schools Superintendent Chris Reuter said around 70 students and 20 adults were in the building for events during the rooftop shootout.
"All of a sudden this janitor come running like really scared... He told us some guy was on the roof like shooting and half of us didn’t hear it. We started running in the back," Inga said.

The involved officers have been placed on administrative leave, per agency policy.
DCI is leading the investigation and is assisted by Washington County Sheriff’s Office, Wisconsin State Crime Laboratory, the Wisconsin State Patrol, a DCI Crime Response Specialist, and members of the DCI Digital Evidence Unit. All involved law enforcement are fully cooperating with DCI during this investigation.

DCI will review all evidence and determine the facts of the incident and will turn over investigative reports to the Washington County District Attorney when the investigation concludes.
