Police say 26-year-old Racine man was heavily intoxicated when he head-butted Jimmy John's window

RACINE COUNTY (WITI) -- A 26-year-old Racine man has been charged, accused of disorderly conduct in an incident that occurred on Monday, March 16th.

Jeremy Smith is facing one count of disorderly conduct (repeater) and one count of misdemeanor bail jumping.

It was shortly after 1:30 p.m. Monday when police were dispatched to the 100 block of Main Street in Racine to check the welfare of an intoxicated person who had head-butted a window at the Jimmy Johns store there. There, police found Smith, who appeared to be heavily intoxicated. Police say he could barely stand on his own.

Police say Smith was at first apologetic for his behavior, but he soon began crying -- saying he just wanted his mother.

A criminal complaint says Smith told police he drank some vodka.

Police spoke with a manager at the Jimmy Johns store, who advised that Smith was argumentative with workers and refused to leave when asked. As workers tried to get him ot leave the store, the complaint says Smith head-butted a glass window. The window was not damaged.

Police were able to reach Smith's fiancee, who advised she would watch over Smith if they could find a ride for him.

As police were helping Smith into a squad car, police say he suddenly became combative -- clenching his fist, and using unreasonably loud and profane language toward police -- telling one officer: "I hope you and your daughters die."

Smith was then taken into custody.

He was taken tot he hospital for a medical evaluation due to his level of intoxication. At the hospital, the complaint indicates a pint of vodka that was three-fourths empty was removed from Smith's pocket. Police say Smith's disorderly behavior continued at the hospital.

When he was discharged from the hospital, Smith was taken to the Racine County Jail where he was being held.

Smith was out on bond at the time of this crime -- having been released on February 17th on the condition he commit no new crimes. In that case, Smith faces two counts of disorderly conduct and two counts of resisting or obstructing an officer.
