Village of Lake Delton not liable for 2008 flood losses
MADISON (AP) — A Wisconsin appeals court says the Village of Lake Delton isn't liable for lakeshore homes that were destroyed during a 2008 flood.
A section of Lake Delton shoreline blew out during the flood. The lake drained away through the breach, taking a number of lakeshore homes with it. Video of the houses breaking apart was broadcast worldwide.
The residents sued the village in 2009 alleging the village took their property without proper compensation. A Sauk County judge ultimately found the village took no action that caused the losses.
The 4th District Court of Appeals upheld that decision Thursday, agreeing no village action caused the losses and the municipality bears no liability for compensation.
The residents' attorney didn't immediately respond to an email message.
